Terms of Service
The agreement between you and MAUD LLC for using Cobblehop. Effective date: October 28, 2026.
- Cobblehop is a helper, not an official source. Times, routes, platforms, live predictions, AI answers and stop alerts can be late, wrong or fail. Always check official signs, announcements and agency sources.
- You use it at your own risk. We are not responsible for missed trips, delays, extra costs, fines, injuries or other losses, and our liability is capped (Sections 4, 13 and 14).
- Try it, then create an account. You can plan a few trips without an account; to keep using Cobblehop you need one. You must be at least 13, and under 18 only with a parent or guardian's permission. Don't misuse the service.
- Some access may require a paid pass. Any price is shown before you pay, and payments are non-refundable except where the law requires.
- Disputes go to individual arbitration, not court. You waive class actions and jury trials unless you opt out within 30 days (Section 17).
- Not for emergencies. If you are in danger, call 911. Never use Cobblehop while driving.
Important: Section 17 requires you and MAUD LLC to resolve most disputes through binding individual arbitration instead of in court, and waives jury trials and class actions. You can opt out within 30 days (Section 17.7).
1. About these terms
Cobblehop is operated by MAUD LLC, a Pennsylvania limited liability company based in Erie, Pennsylvania, USA ("Cobblehop," "we," "us" or "our"). These Terms of Service ("terms") govern your use of cobblehop.com, the Cobblehop web app, any future Cobblehop apps (such as for iOS or Android), and all related features, alerts, emails and support (the "service").
By creating an account, accepting these terms when asked or using the service, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use Cobblehop. Additional terms we show you for a feature (for example, at checkout) also apply and control for that feature if they conflict.
2. What Cobblehop is
Cobblehop plans public-transit trips across Massachusetts, plus some nearby trips into Rhode Island, New Hampshire and Connecticut. You type or say where you are going, and an AI assistant replies with a route card (what to board, when to leave, stops and arrival), live departures and an optional "buzz me before my stop" alert. The alert uses vibration, sound, screen flashes and notifications, and keeps your screen awake while you ride.
Cobblehop is independent. It is not affiliated with, endorsed by or operated by the MBTA, MassDOT or any transit agency. We do not run any transportation and have no control over schedules, service, fares, stations or vehicles.
3. No guarantees: always check official sources
Cobblehop is a planning aid, not an official source. We do not promise that anything it shows or says is accurate, complete, current or available when you need it. In particular:
- Transit information. Schedules, routes, times, platforms and tracks, live predictions, vehicle locations, alerts and fares come from transit agencies and other sources. They can be late, wrong, incomplete or missing, and can change without notice. Without live data, Cobblehop may show scheduled times.
- AI answers. The AI assistant can misunderstand you, mix up places, routes or times, leave out details or be confidently wrong.
- Stop alerts. The alert may come early, late or not at all. It can fail because of phone or browser settings, silent or do-not-disturb mode, notification permissions, low battery or battery saving, a locked screen, the tab or app being closed or in the background, browser limits, no signal, or GPS and vehicle-location errors. Never rely on it as your only way to know when to get off.
- Walking directions and accessibility. Walking routes and times are estimates that may not reflect closures, construction, weather or safety. Elevator, ramp and other accessibility information may be out of date or wrong; confirm it with the agency before you travel.
Always check official signs, announcements, station staff and the transit agency's own sources, and follow them when they differ from Cobblehop.
Cobblehop is not for emergencies. If you or someone else is in danger, call 911 or alert transit staff.
Your safety is your responsibility. Stay alert near platforms, tracks and roads, follow all laws and agency rules, pay required fares, and never use Cobblehop while driving.
4. Use at your own risk
You decide how and when to travel, and you use and rely on Cobblehop at your own risk. To the fullest extent permitted by law, MAUD LLC and its members, managers, officers, employees, contractors, agents, licensors, service providers and data providers (the "Cobblehop Parties") are not liable for any loss or harm resulting from your use of or reliance on Cobblehop, including:
- missed or late trains, buses, ferries, flights or connections, and any delays;
- missed appointments, work, school, events or reservations;
- extra costs, such as taxis, rideshares, hotels or rebooked tickets;
- fares, fines, citations or tickets;
- lost, stolen or damaged belongings;
- personal injury or property damage; and
- any other loss of any kind.
See Sections 13 to 15 for the full disclaimers, our liability cap and your duty to indemnify us.
5. Who can use Cobblehop
You must be at least 13 years old to use Cobblehop. If you are under 18 (or the age of majority where you live), you may use it only with permission from a parent or legal guardian, who agrees to these terms for you and is responsible for your use. You must be 18 or older to buy a paid pass, or have a parent or guardian buy it for you.
Cobblehop is not directed at children under 13; if we learn a child under 13 has an account, we will close it and delete its information. You may not use Cobblehop if the law prohibits it or we have banned you.
6. Your account
You can try Cobblehop without an account for a few trips. After that you need an account to keep using it. You agree to give accurate information (your first and last name, email address and phone number) and keep it current; to keep one account per person and not share, sell or transfer it; to keep your password secret; and to tell us right away at team@cobblehop.com about any unauthorized use. You are responsible for all activity under your account.
You can delete your account at any time by emailing team@cobblehop.com from your account email.
We may email you about your account and the service, such as security notices and changes to these terms. Marketing emails will always include an unsubscribe option, and we will not send marketing texts unless you separately opt in.
7. Paid passes and payments
Continued access after an initial period may require a paid pass. We decide whether to offer an initial period and what it includes, and we may change or end it at any time.
- Price shown first. Any price is shown before you pay. Taxes may apply.
- Stripe. Stripe processes payments under its own terms and privacy policy. We never see or store your full card number.
- Google Play. In our Android app, passes are bought through Google Play and processed by Google under its own terms and privacy policy.
- No automatic renewal. Your access ends when your paid period ends. Nothing renews automatically unless that is clearly stated at checkout.
- No refunds. Payments are final and non-refundable, including for unused access, except where the law requires a refund.
- Changes. We may change prices, passes and plans at any time. Changes apply to future purchases.
- Personal use. A pass belongs to your account, cannot be transferred or resold, and is not a transit ticket or fare.
If you dispute a charge or a payment is reversed, we may suspend your access while we look into it. If we close your account because you broke these terms, no refund is due except where the law requires. App store purchases also follow the store's billing and refund rules.
8. Acceptable use
Use Cobblehop only for lawful, personal trip planning. You agree not to:
- scrape, crawl or harvest Cobblehop, or access it with bots, scripts or other automated means (public search engines may index our public pages);
- reverse engineer or decompile the service, or try to extract its code, prompts or data, except where the law allows;
- overload or disrupt the service, or introduce malicious code;
- get around security measures, usage limits, paywalls or access controls, including by using multiple accounts or by clearing or faking guest or device IDs;
- access or try to access anyone else's account or data;
- resell or commercially exploit the service or its output, or use them to build a competing product or train AI models;
- use Cobblehop for anything illegal, or to harass, threaten, abuse or impersonate anyone;
- misuse the AI assistant to produce harmful content or for purposes unrelated to trip planning; or
- help anyone else do any of these things.
We may investigate suspected violations and limit features, suspend or close accounts, or report conduct to law enforcement.
9. Your content, feedback and AI answers
Your content. You keep your rights in the messages, trip requests, feature requests and other content you send us. You grant MAUD LLC a worldwide, non-exclusive, transferable, fully paid-up license, with no royalties owed and sublicensable to our service providers, to host, store, copy, process, analyze and display your content, for as long as we keep it under our Privacy Policy, to operate, secure and improve the service, including by having our team review messages, feature requests and support issues and by training and testing the models that power Cobblehop on de-identified conversations.
Feedback. You grant us a perpetual, irrevocable license to use any ideas, suggestions or feature requests you send for any purpose, without restriction, payment or credit to you.
AI answers. Output from Cobblehop is for your personal, non-commercial trip planning only. It may be wrong (see Section 3), may resemble output given to others and is not professional advice.
10. Our intellectual property
Cobblehop, including its software, design, text and the Cobblehop name and logo, belongs to MAUD LLC or its licensors. Subject to these terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the service for personal, non-commercial trip planning. We reserve all other rights. MBTA, MassDOT and other agency names belong to their owners and are used only to identify their services.
11. Data sources, third parties and apps
Data sources. Transit schedules and real-time data come from MassDOT and the MBTA, under the MassDOT developer license, and from other public transit agencies, including regional transit authorities, Amtrak and ferry operators. Map data is © OpenStreetMap contributors and available under the Open Database License (ODbL). We do not control these sources. The agencies do not endorse Cobblehop and are not responsible for it.
Third parties. Cobblehop relies on and may link to services run by others, such as Stripe, Google Play, place search, agency websites and your browser's or device's features (speech recognition, location, notifications and vibration). We are not responsible for them; your use of them is at your own risk and subject to their terms.
Mobile apps. If you get a Cobblehop app from an app store, the store's terms also apply, but these terms are between you and MAUD LLC only. The store has no obligation to support the app, no warranty obligation for it (to the extent the law allows) and no responsibility for claims about it. You confirm you are not in a U.S.-embargoed country or on a U.S. restricted-party list. App stores are third-party beneficiaries of these terms and may enforce them against you.
12. Changes to the service
We may change, add or remove features, coverage areas, data sources or limits, or suspend or discontinue all or part of the service, at any time and with or without notice. To the fullest extent permitted by law, we are not liable to you for any such change.
13. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, COBBLEHOP AND EVERYTHING AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. THE COBBLEHOP PARTIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT COBBLEHOP OR ANY INFORMATION, AI ANSWER, ROUTE, TIME, PREDICTION, DIRECTION OR ALERT WILL BE ACCURATE, COMPLETE, TIMELY, RELIABLE, SECURE OR AVAILABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR WITHOUT ERRORS.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COBBLEHOP PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, TIME OR GOODWILL, ARISING OUT OF OR RELATING TO COBBLEHOP OR THESE TERMS, INCLUDING THE LOSSES LISTED IN SECTION 4, EVEN IF TOLD THEY WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COBBLEHOP PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO COBBLEHOP OR THESE TERMS, UNDER ANY LEGAL THEORY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR STATUTE), WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR COBBLEHOP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.
These limits are an essential part of our bargain and apply even if a remedy fails of its essential purpose. They do not limit liability that cannot legally be limited, such as for fraud, gross negligence or willful misconduct where the law forbids it.
15. Indemnification
To the fullest extent permitted by law, you will defend, indemnify and hold harmless the Cobblehop Parties from any claims, losses, liabilities, damages, fines, costs and expenses (including reasonable attorneys' fees) arising out of your use or misuse of Cobblehop, your content, your breach of these terms, or your violation of any law, agency rule or anyone else's rights. We may control the defense of any such matter; you will cooperate and will not settle it without our written consent.
16. Suspension and termination
You may stop using Cobblehop and delete your account at any time. We may suspend, limit or end your access, or close your account, at any time and with or without notice if we believe you broke these terms, abused the service, failed to pay or created risk or legal exposure for us or others, if the law requires it, or if we discontinue the service. Sections that by their nature should survive, including Sections 4, 7, 9, 10 and 13 to 20, will survive.
17. Disputes: binding arbitration and class-action waiver
Please read this section carefully. It affects your right to go to court.
17.1 Informal resolution first
Before starting arbitration or a small-claims case, the party with the dispute must send the other a written notice describing it and the relief sought: you from your account email to team@cobblehop.com, and we to your account email. We will both try in good faith to resolve it for 30 days after the notice is received, and filing deadlines are paused during that time. After that, either of us may start arbitration or, where allowed, a small-claims case.
17.2 Agreement to arbitrate
Except as stated in Section 17.3, you and MAUD LLC agree that any dispute arising out of or relating to these terms, Cobblehop, our Privacy Policy, any payment or your relationship with us, under any legal theory and whether it arose before or after you accepted these terms, will be resolved by final and binding individual arbitration, not in court. The arbitrator will decide all questions about the scope, enforceability and formation of this agreement to arbitrate, except that only a court may decide questions about Section 17.5.
17.3 Exceptions
Either of us may bring an individual claim in small-claims court if it qualifies, or ask a court for an injunction to stop intellectual property infringement, unauthorized access to the service or a breach of Section 8. A request for public injunctive relief that the law does not allow to be waived will be decided by a court after the arbitration ends.
17.4 How arbitration works
The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules (and any supplementary rules it applies to mass filings) then in effect, available at adr.org, as modified by this section. A single arbitrator will decide the dispute, which may be done by video, phone or written submissions; any in-person hearing will be in the county where you live unless we agree otherwise. Fees are governed by the AAA's rules. The arbitrator may award only individual relief and must apply these terms, including Sections 13 and 14. Judgment on the award may be entered in any court with jurisdiction.
17.5 Class-action waiver
YOU AND MAUD LLC MAY EACH BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine more than one person's claims unless we both agree in writing. If this waiver is found unenforceable for a claim or request for relief, that claim or request alone will be severed and decided by a court under Section 18, after the arbitration ends.
17.6 Jury-trial waiver
IF ANY DISPUTE PROCEEDS IN COURT INSTEAD OF ARBITRATION, YOU AND MAUD LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL.
17.7 Your right to opt out
You can reject this agreement to arbitrate by emailing team@cobblehop.com from your account email within 30 days after you first accept these terms (for example, when you create your account). Include your name and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these terms.
17.8 Changes to this section
If we materially change this Section 17, you may reject the change by emailing team@cobblehop.com from your account email within 30 days after it takes effect. The version you last accepted will then continue to apply.
17.9 Survival and severability
This section survives the end of your account and of these terms. Except as stated in Section 17.5, if any part of it is found unenforceable, the rest remains in effect. The Federal Arbitration Act governs this section.
18. Governing law and venue
Pennsylvania law governs these terms and any dispute between you and us, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 17. Any dispute that is not arbitrated (other than a small-claims case) must be brought only in the state or federal courts located in Erie County, Pennsylvania, and you and we consent to their personal jurisdiction. This does not remove protections under consumer laws that cannot be waived by contract.
19. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and, for material changes, also notify you in the app or by email, before the change takes effect where reasonably possible. Changes are not retroactive, and Section 17.8 covers changes to Section 17. Continuing to use Cobblehop after a change takes effect means you accept it; if you do not agree, stop using Cobblehop and delete your account.
20. General terms
- Entire agreement. These terms, our Privacy Policy and any additional terms we show you are the entire agreement between you and us about Cobblehop.
- Severability and no waiver. If any part of these terms is unenforceable, it will be enforced to the extent allowed and the rest stays in effect. Not enforcing a term is not a waiver of it.
- Assignment. You may not transfer these terms or your account without our written consent. We may assign them, for example in a merger, acquisition or sale of assets.
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, such as transit or data outages, strikes, severe weather, internet or hosting failures, cyberattacks or government action.
- Notices. We may give you notices by email to your account email or in the app, effective when sent; send notices to us at team@cobblehop.com. Electronic notices satisfy any writing requirement.
- Other. Only the Cobblehop Parties (under Sections 4 and 13 to 15) and app stores (under Section 11) are third-party beneficiaries. These terms create no partnership, agency or employment relationship. Headings and summaries, including "The short version," do not affect their meaning, and "including" means "including without limitation."
